VEENA HAYAT RAPE A HORRIBLE HISTORY

How the Pakistani laws have emboldened rapists or would-be rapists has been dramatised a number of times. In 1991, a political supporter of Ms Bhutto was gang-raped for hours by Karachi's Central Investigative Agency (CIA) men in her own house. Veena Hayat was a daughter of veteran Muslim Leaguer Sardar Shaukat Hayat who was a companion of Quaid-i-Azam Mohammad Ali Jinnah. The rape was organised by the then President Ghulam Ishaq Khan's son-in-law Irfanullah Marwat who was in control of the Karachi CIA. The police registered Veena's complaint only when the then Army Chief General Asif Nawaz intervened. President Khan, who was at loggerhead with then Prime Minister Nawaz Sharif stepped up his moves to remove him fearing he would arrest his son-in-law Marwat. In the subsequent political upheaval in 1993, both Prime Minister Nawaz Sharif and President Khan had to go. Nothing was heard of Veena's case any more in the den of this political crisis.

In the Pakistan of Fatima Jinnah and Benazir Bhutto, according to government statistics, every day two women are abducted, one is raped and forty-five or so severely beaten up that throwing all modesty to the winds, lodge complaints with the police. On an average, two women are burnt to death by lighted stoves either accidentally, with self-inflicted burns or (mostly) deliberately killed. A Pathan leader of the Frontier Province and self-styled associate of Benazir Bhutto, Ms. Veena Hayat, was molested in broad day light by the son-in-law of then President Ghulam Ishaq Khan; how far can the modesty of a common woman be safe in Pakistan under the present administration, is an open question. Pakistan today is a veritable hell for women because goondas (hoodlums) and bad characters never allow them to live peacefully with honor and the government goes on introducing laws that are loaded in favor of Moslem males. A woman undergoing the horrendous experience of rape has the burden of proving that the specific man raped her. And she needs four eye-witnesses to do that according to the Islamic laws of the Sharia'. And in case she is not able to prove beyond reasonable (?) doubt, the Hadood Ordinance, ever in the eye of the controversy, has vested the government with arbitrary powers to punish women in the name of the Shariat.

On November 27, 1991, Veena Hayaat, a personal friend of PPP leader Benazir Bhutto, reportedly was beaten and gang-raped in her home by five men acting on orders from local government officials. According to Hayaat's testimony, the men "just went berserk. They were like animals" and she was "savagely beaten and molested for 12 hours." Two of the men raped her repeatedly. They said to her they were acting on the orders of "higher-ups." (225)

Unlike the case of Kursheed Begum, Veena Hayaat's case attracted immediate national attention. She charged that the President's son-in-law, Irfanullah Marwat, home advisor to the chief minister of Sindh, was behind the incident. The Sindh government requested that the Chief Justice of the Sindh High Court appoint a judge to investigate. According to retired Supreme Court Justice Dorab Patel, who heads the Pakistan Commission on Human Rights, the creation of this tribunal was "almost unprecedented," particularly given that "there is no right of appeal against the finding of this tribunal." (226) The family, who said they lacked confidence in the independence of the judiciary, refused to cooperate with the inquiry. Instead, they resorted to a traditional custom of calling a village meeting (jirga) to hear the case. The jirga pronounced death sentences against the accused. (227)

Both the jirga and the special judicial inquiry were irregular criminal justice measures, neither of which met the basic requirements for a proper criminal investigation. The family's refusal to cooperate made it impossible to clear up inconsistencies in the record, and the judge overseeing the inquiry denounced the police investigation as suffering from "culpable omission and negligence." (228) Nonetheless, the inquiry was completed on December 24, 1991, and found Murwat innocent of all charges. No other criminal investigation is being pursued.

It was during those times that one entered the world of journalism, with the inception of The News. As young "cub" reporters, we routinely filed stories of the worst style of political victimization. Irfan-ullah Marwat, son-in law of former president Ghulam Ishaq Khan, and Sami-ullah Marwat, head of the CIA were considered particularly "notorious" and known to be Jam Sadiq's men in the field. Imtiaz Sheikh, now a bitter political enemy of Arbab Rahim, was considered to be the major political wheeler-dealer for Jam Sadiq Ali. So there is nothing new about Arbab's alleged targeting of Jam Saqi in this political culture; it is simply a reflection of our vicious feudal and tribal system. Politicians with feudal backgrounds project themselves as refined, cultured and well-educated when in Islamabad or Karachi. Back in their own villages and
"constituencies", the masks drop. They are demigods. Some keep a single chair in their sitting room or autak, so the villagers or their mazaras sit on the floor. The villagers walk backwards out of rooms so as not to turn their backs on the politicians, many of whom are "gaddi nashins". They mingle freely with men and women alike at private parties in big cities, but back in their own areas, they laugh when their speedy four wheelers worth millions splash dirt on peasants by the way-side.Perhaps the relationship between Jam Saqi and Arbab Rahim is of a feudal lord and a peasant. Jam Saqi hails from the village Jingi in Thar, which falls in Arbabs' constituency. Jam Saqi's father Sacchal was a teacher who set up a school for girls and boys, something that traditional politicians have never liked.

The drug crackdown was short-lived, however. When General Zia's former finance minister, Ghulam Ishaq Khan, became President of Pakistan, many of the indictments were overturned or never prosecuted. Ghulam Ishaq Khan had been General Zia's liaison to the Bank of Credit and Commerce International, serving as the president of the BCCI Foundation, the "charity" through which drug money was laundered, and bribes were paid out. The DEA's most recent annual study of the supply of illicit drugs to the United States reported that opium production and processing in Afghanistan has increased, and that a crime syndicate based in Quetta, Pakistan has emerged as a major channel for Afghani heroin into the United States and western Europe.
